The Kirovsky District Court of Saratov sentenced the dismissed Interior Ministry investigator Takhir Gyulakhmedov to 5.5 years in a general regime colony. He fabricated the materials of the criminal case, which is why his brother went to the colony instead of the culprit in drug trafficking. The case of Gyulakhmedov was considered by judge Pavel Pimenov, it says in the business card.
Gyulakhmedov was found guilty under Part 2 of Art. 299 of the Criminal Code (bringing a knowingly innocent person to criminal responsibility, combined with accusing a person of committing a serious crime) and part 3 of Art. 303 of the Criminal Code (falsification of evidence in a criminal case of a serious crime), informs management of the RF IC in the Saratov region.
On June 15, 2019, employees of the private security department detained a 26-year-old resident of Saratov Alexander Studentov on Gvardeyskaya Street in the case of drug possession on a large scale (part 2 of article 228 of the Criminal Code), writes Mediazona. At the time of his arrest and after being brought to the police station, he introduced himself as Dmitry Rubinstein – that is the name of the adopted son of Studentov’s mother. A day later, a criminal case was opened against the man whom the suspect had impersonated.
Later, one of the police officers, who was personally acquainted with the suspect, told investigator Gyulakhmedov that Students were impersonating another person. However, the investigator “ignored” this information.
Moreover, on behalf of his colleague, Gyulakhmedov prepared a new document on the interrogation of the suspect, thereby eliminating the contradictions that had arisen. The investigator destroyed the original protocol. Gyulakhmedov also prepared, on behalf of the previous investigator, a decree and a seizure protocol on the seizure of a suspect’s mobile phone and a report on attaching a copy of Rubinstein’s passport and military ID to the materials of the criminal case, which he gave the Students to the police.
Having falsified the evidence, Gyulakhmedov carried out the rest of the investigative actions with the accused, posing as another.
In August 2019, Studentov as Rubinstein was sentenced to three years of probation with a probationary period of 4 years. In February 2020, the term was changed to a real one due to non-execution of the sentence. Rubinstein was put on the wanted list, detained in March 2020 and sent to a colony, where he remained until August 25. “Despite the defendant’s refusal to admit his guilt, the court found it fully proven that he had committed the incriminated acts,” the Investigative Committee noted.
At the moment, Students are serving time in a drug case.
