The Moscow court of appeal ordered the blogger Ilya Varlamov to remove the post in which he called opponents of the new rules for placing signs in Petrozavodsk “shit guards.” About it writes “7×7” with reference to lawyer Natalia Soyunen, who represented the interests of the plaintiffs – representatives of the city association of homeowners “Lenina 18B”.
In October last year, Varlamov published a post on the website Varlamov.ru “Shit guardians guarding visual debris”, in which he criticized entrepreneurs and representatives of the Lenin 18B homeowners association for dissatisfaction with the new requirements for the placement of signs on the facades of buildings.
The HOA filed a lawsuit to protect honor, dignity and business reputation against Varlamov in February this year. “In the course of his speech in the Meshchansky court, the plaintiff’s representative, a lawyer from Petrozavodsk, pronounced the word ‘shit guardians’ 12 times. Thanks to Ilya Varlamov for the fascinating process “, – so commented on this case is lawyer Sergey Badamshin in his Telegram channel in May of this year (author’s punctuation preserved).
According to Soyunen, the court now ordered the blogger to remove the publication and post the operative part of the judgment on its website as a refutation. In addition, 15 thousand rubles were collected from Varlamov in favor of the lawyer and 10 thousand rubles in favor of the HOA. Initially, the plaintiffs requested compensation in the amount of RUB 2 million.
“When we went to court, we had no goal of getting money. All the goals that we set were to check whether it is possible to defend your business reputation in court if you stand against such a well-known, popular blogger, “7×7 quotes Natalia Soyunen as saying.
Varlamov himself was not present at the hearings; his interests were represented by lawyers. The blogger did not publicly react to the loss in court.
