For the first time in Russian court practice, a resident of the Tyumen region won a moral damage case due to an Instagram post. About it informs united press service of the courts of the region.
We are talking about the stories in the account of his ex-wife. The couple was married for eight years and divorced in 2019 at the initiative of the wife. In February 2020, the woman began to publish on her Instagram stories about how her ex-husband was trying to evict her and the children from the apartment, take away the car and evade paying alimony. She also claimed that the husband lived at her expense in the marriage.
The man went to court. In the lawsuit, he demanded that the ex-wife publish a refutation of information discrediting his honor and dignity, and not remove this post for a year, and also pay him compensation for moral damage in the amount of 30 thousand rubles.
The Tyumen District Court rejected this application. Then the man filed an appeal, confirming his position with certificates of income, bank checks on the payment of alimony, mortgages and educational services for children. The Collegium for Civil Cases of the Tyumen Regional Court partially satisfied the plaintiff’s claims. The court ordered the defendant to publish a refutation and not delete it within 24 hours, as well as pay her ex-husband five thousand rubles.
