The Supreme Court of Udmurtia partially satisfied the claim of residents of the village of Pugachevo for compensation for moral damage due to explosions of ammunition at the warehouse of the Ministry of Defense of the Russian Federation in 2011 and 2018. The total amount of the plaintiffs’ claims exceeded 6.7 million rubles. Before the trial, they turned to the Bureau of Independent Forensic Medical Examinations LLC, whose experts revealed post-traumatic syndrome and serious health problems in the victims. “One woman, for example, had an aggravated coronary artery disease, while others had an increase in blood pressure. Everyone was stressed when a person is afraid of loud noises, shots and so on, ”said Danil Kholodnitsky. However, the Malopurginskiy District Court on February 10, 2020 refused to satisfy the applicants’ claims.
The plaintiffs appealed to the Supreme Court of Udmurtia, which overturned the district court’s decision and indicated that, when considering the claim, the judge unreasonably excluded the experts’ conclusions from the evidence. The Meleuzovsky court of Bashkiria also partially satisfied the claim of one of the victims of the explosion in 2011, Danil Kholodnitsky. He was paid 500 thousand rubles for causing moral harm.
Meanwhile, the National Committee for Combating Corruption in the Russian Federation came to the conclusion that the actions of the judge of the Malopurginsky District Court contain “clear and unambiguous signs of an official corruption of a corrupt nature, expressed in the use of official position.”
According to Danil Kholodnitsky, the victory of the residents of Pugachev in the Supreme Court is a precedent in Russia. “I have a desire to change the legislative practice of the Russian Federation for the better. Because the Russian Federation does not always protect its citizens. By uniting, we can achieve justice. For our country to compensate for the harm to our health, ”he stressed.
After the victory of the villagers, the Sixth Court of Cassation of General Jurisdiction overturned the appeal decision of the Supreme Court.
