After a week of obscurity, my client, Alexander Gabyshev, showed up in an intensive care hospital in Novosibirsk – Yakutia is also under the jurisdiction of this institution. The fact that he was taken away somewhere, learned, one might say, by chance, his sister, when she came to the next date. At the same time, neither the Yakut Ministry of Health, nor the SIZO, according to the established practice in Russia, provided information to either the relatives or his defense.
I want to say right away that the whole story with the compulsory treatment of Gabyshev and his imaginary insanity – pure punitive psychiatry for political purposes of the Soviet model – for this the Soviet Union paid for membership in the World Psychiatric Association. But since Soviet times involuntary hospitalization Gabysheva is the first such case, a precedent.
The political motive can be traced in the conclusions of the medical commissions of the Yakut psychiatric dispensary: psychiatrists discovered in the shaman “delusional ideas of reform.” In their understanding, if you come up with some political demands and think that something needs to be changed in the country, then you are a schizophrenic. On the one hand, the Constitution stipulates that you have every right to talk about it, but in fact you are punished for it, and in Gabyshev’s case – by compulsory treatment. Actually, this speaks of their own psyche: the hope for changes in Russia is for them an everyday madness. I’m not a psychiatrist, but all of this is bipolar power disorder.
From my communication with Gabyshev, I can confidently say that this is a non-aggressive person, absolutely peace-loving. He proclaimed the same thing many times – at any turn of events it is necessary to ensure that not a single hair falls from the heads of the people who are in power. There was no talk of any armed uprisings. The video footage, which the prosecution operates, was monitored by unknown people from various speeches and posted on the Web by an unknown person without Gabyshev’s knowledge. It was not possible to achieve a personal appearance and testimony of this person – they say that he was not found.

Gabyshev is a very positive, literate, very well-versed person in modern times. Even now, when he was in the hospital, and was in jail immediately, as soon as we crossed paths somewhere in the processes, he almost demanded a report on what was happening in the country, in the world. I did not reveal any, even the slightest, signs that he had a mental disorder at the everyday level: he is in a sober mind, gives an account of what is happening. And there is no sense of danger next to him.
Recognition as insane requires recorded formal signs – for example, a suicide attempt or danger to others. Throughout his life, despite the stresses that were when his wife died, he never expressed thoughts of suicide. Also, there is not a single message about calls to the police, reports from the district police officer, where it was said that he threatened someone. On the contrary, there are positive reviews from neighbors and acquaintances, from his own sister that he runs a household, deals with children, plays with them. After his wife died, he no longer married, lived with his sister on a large plot of land, on which there are two or three houses. All the village economy (plot, heating) was on it. Neat, neat. He confidently uses modern technology, instant messengers, phones and all that.
And although earlier they had already tried to “treat” him, the decisive turn was in the spring of 2020, when Gabyshev announced the resumption of the campaign against Moscow. A motley delegation came to his home under the pretext of a coronavirus test. It should be noted that Gabyshev observed strict self-isolation, and did not even let his defenders go beyond the threshold. However, the police, led by Oleg Lebed, the deputy chief of the Yakut police, literally broke into his house and, without even giving him shoes, took him to a mental hospital. There is a paper in the case – “Delivered without documents and medical documents, in one shoe, refused hospitalization. There are no grounds for hospitalization. ” That is, there was some kind of inconsistency, and he was brought back.

But a claim for recognition as insane was filed. We filled up the court with all sorts of expert opinions. When in September 2019 there was an attempt to imprison him for the first time, they turned to the Independent Psychiatric Association, representing Russia in the World Psychiatric Association, they worked with him on the spot, reviewed the conclusion of the medical commission. The Supreme Court of Yakutia even agreed to grant the petition to appoint an examination in another institution, and then the next morning, when the trial was over, it was announced that the examination would be carried out in the Yakut neuropsychiatric dispensary, which was the plaintiff. For two years we have been seeking to conduct an examination in another region, but to no avail.
At the same time, people sympathize with him, and they help financially, including with payment for examinations, flights, (conclusions. – The Insider) specialists. And especially in Yakutia. Even at the criminal trial, prosecution witnesses, police and Rosgvardia officers, spoke positively about him, and even the aforementioned Oleg Lebed personally appreciated him from a positive side, only adding that “someone is manipulating him.”

But in the end, on January 27, 2021, the detention of Gabyshev was organized on a huge scale, a plan for which was developed and formalized by orders of the Minister of Internal Affairs of Yakutia and the head of the local Rosgvardia. The total number of people involved in the operation was 55 people and 10 pieces of equipment, ranging from the traffic police, which cordoned off several blocks around, and ending with a detachment of the Russian Guard. It was an invasion, a real attack on his home. He tried to resist, so there was a case of damage to the National Guard, supported by torn trousers, and the lining of the trousers attached to the case remained intact, I myself held these trousers in my hands.
In general, in the Gabyshev case, the authorities made all the procedural errors and inconsistencies that one can imagine. Of course, we will continue to challenge all of these decisions. Now we have – confession of insanity, placement in a pre-trial detention center at the time of the appeal, and secret deportation to Novosibirsk. Our first task is to meet him at a hospital in Novosibirsk.
