The Supreme Court dismissed the case against Tatyana Vorobyeva, a resident of the village of Kislovo, Volgograd Region, who stabbed her boyfriend who had attacked her. About it informs “Zone of law”.
In September 2019, a woman’s roommate quarreled with her because he often drank alcohol, after which he began to insult and beat her. When Vorobyova asked him not to drink and go to bed, the man grabbed her by the throat and began to choke her, and hit her on the shoulder with the other hand. The woman tried to push him away and stabbed him in the chest.
Female toldthat she hit him accidentally because of a threat to life – she could not breathe. The man claimed that he had no complaints against her, since Vorobyova “looked after him” and asked for an apology. Despite this, a criminal case was opened against Vorobyeva on deliberate infliction of grievous bodily harm (clause “c”, part 2 of article 111 of the Criminal Code). The district court found that the woman knew that the roommate was drunk and aggressive, but allegedly “did not yield to the victim in the conflict.”
In the summer Vorobyov sentenced by two years in prison. Serving her sentence was postponed until her young daughter grew up. The regional court later changed the sentence to six months of corrective labor conditionally, softening the qualification of the case (part 1 of article 114 of the Criminal Code). The Supreme Court also held that the woman’s actions were necessary self-defense. The ruling of the court says that “Vorobyova stabbed with a knife precisely at the moment of danger to her life in order to save herself.”
