Courts in St. Petersburg refused to recognize a transgender woman as the mother of the children she was a father to before the sex change. About it informs united press service of the city courts.
The decision was made by the District Court and then by the Appeals Board of the St. Petersburg City Court
According to the plot of the case, the applicant’s wife died. After performing the operation, the man changed sex and received new documents. To resolve issues related to children, she needed to confirm the status of a parent. According to her, this forced each time to clarify the situation and caused moral suffering.
The Petersburg woman turned to the regional registry office with the requirement to enter her in the birth certificates of children as a mother, and put a dash in the column “father”. The registry office refused to do this, and the transgender woman filed a lawsuit.
The district court, when deciding on the claim, pointed to the priority of the interests of children.
“Every child has the right to know his biological parents and family (genetic) history, the right to receive reliable information about the identity of the parents, as well as the right to communicate with relatives, in this case on the mother’s side. If the application is satisfied, the data on the biological mother of the children disappears, ”the court decided.
